Dispute Resolution

Meet a part of the dispute resolution and process group at Brick Advokat! Our dispute resolution and process group includes, among others, Johan Isaksson, Mathilde Ramel, and Aksel von Sydow. All three come from a background in the judiciary and now play a central role in the disputes where Brick Advokat acts as an advisor.

Johan Isaksson is a lawyer with over eight years of legal experience within the judiciary. He has also taught procedural law at Stockholm University and has completed special judge training and was appointed as a Court of Appeal Assessor at Svea Court of Appeal in 2017. Before joining Brick Advokat in 2020, he worked as a Justice Secretary at the Supreme Court. He regularly represents clients in proceedings in general courts and in arbitration proceedings, especially in construction disputes. Johan is responsible for Brick Advokat's dispute resolution and litigation group.

Mathilde Ramel joined us as an associate in 2022. Mathilde has worked with processes, as a representative or at court, throughout her career. She has completed special judge training and was appointed as a Court of Appeal Assessor at Svea Court of Appeal in 2022. During the judge training, she also served a year at the Supreme Court.

Aksel von Sydow has been working with processes in general court since 2009, both as a representative and during work at court within the framework of special judge training at Svea Court of Appeal and Stockholm District Court. Aksel joined Brick Advokat in March 2023 and has represented our clients primarily in construction and commercial lease disputes.

 

Tell us about Brick Advokat's dispute resolution and litigation group!

Since the firm started, we have represented clients in commercial disputes with a focus on the construction and real estate industry and over the years developed a group with a focus on dispute resolution and process. Through new recruitments of Mathilde Ramel and Aksel von Sydow, the core of the group now consists of three pure process lawyers. The group also includes other lawyers within their respective areas of expertise, both younger associates and partners.

 

How do you work with commercial dispute resolution?

We take overall responsibility for all stages of the dispute and act as a strategic advisor and partner for the client. A dispute shifts time and focus from the business. Our goal is to find the best possible solution to the dispute for the client. This can mean everything from preventing and avoiding disputes to successfully representing clients in processes. When working with dispute resolution, it is also important to have an understanding of business considerations and the client's business and wishes. In disputes, we work in teams where a process lawyer and at least one lawyer with expertise in the legal area that the dispute concerns are included. Among us three pure process lawyers, we also have a division that means that the lawyer who is best suited for the dispute should also drive the process. In this way, the client gets the best advice.

 

How has your background and previous experiences influenced your work in dispute resolution and process?

Our court experience gives us good conditions to understand how a court or arbitration panel reasons during the process and at the dispute's decision. Knowing how it works in court means an understanding of how important it is to be clear and pedagogical both in writing and in oral presentations. Having been a judge and judged in commercial disputes gives an insight into how courts assess evidence and what is required for the evidence requirements in a process to be considered fulfilled. This gives us a good opportunity to assess strengths and weaknesses in the action which in turn means that we can give the client well-founded and cost-effective advice.

 

What qualities do you think are most important to succeed in dispute resolution and process?

In addition to legal knowledge and analysis, it is important to be persistent and curious. You need to be able to delve into details and at the same time maintain a helicopter perspective to discern the most important issues in the process. To succeed, you also need to have a close collaboration with the client, be interested in the client's business and understand the client's needs. Of course, you must also have a winning mentality!

 

How do you see the future of dispute resolution and process? Are there any trends or changes you predict?

Given the ongoing recession, we see a clear tendency for the number of disputes to increase and we predict that it will continue during 2024. The margins for many companies become lower which increases the propensity to dispute. Another change we see in dispute resolution and process is increased digitization with e.g. AI tools. At Brick Advokat, we work to constantly improve and streamline our way of working and we want to be at the forefront when it comes to digital tools and aids. Our ambition is for the dispute resolution and process group to grow in the coming years and that we will continue to be able to give our clients the best advice before and when a dispute arises.
